Terms of Use

Terms governing access to and use of the Titanium Frames website and its B2B eyewear manufacturing information.

Last updated:

These Terms of Use (“Terms”) govern your access to and use of titaniumframemaker.com (the “Website”), which is operated under the public business name Titanium Frames (“Titanium Frames,” “we,” “us,” or “our”). By using the Website, you agree to these Terms. If you do not agree, do not use the Website.

1. Website purpose

The Website provides general information for businesses and professional buyers interested in OEM, private-label, or custom eyewear-frame development. It is not intended for consumer retail sales, and the Website does not currently provide online ordering or payment.

2. No offer or automatic contract

Website content and an initial enquiry are invitations to discuss a potential project; neither creates a binding quotation, purchase order, manufacturing commitment, exclusivity arrangement, or other contract.

Product availability, material selection, construction, dimensions, color, finish, branding, minimum quantities, sample cost, unit pricing, tooling, testing, production schedule, packaging, delivery, and other requirements remain subject to project review and written confirmation.

3. Separate commercial agreements

Any quotation, pro forma invoice, purchase order acceptance, manufacturing agreement, nondisclosure agreement, specification sheet, approved sample record, or other written project document separately accepted by the relevant parties will govern that transaction. If such a document conflicts with these Terms, the separately accepted document controls for that transaction.

4. Permitted use

You may access and use the Website for lawful business-information and enquiry purposes. You must not:

  • use the Website in violation of applicable law or another person’s rights;
  • attempt to gain unauthorized access to the Website, its hosting environment, or connected systems;
  • introduce malicious code, interfere with security, or disrupt Website operation;
  • use automated tools to extract substantial Website content or overload its infrastructure;
  • misrepresent your identity, authority, company, or business purpose; or
  • copy, republish, or commercially exploit Website content except as permitted by law or with our prior written permission.

5. Website content and intellectual property

The Website’s text, graphics, layout, visual elements, and other original content are owned by or licensed to Titanium Frames and are protected by applicable intellectual-property laws. “Titanium Frames” and related identifying material may not be used in a way that implies endorsement, partnership, or authorization without prior written permission.

You may view and make a limited internal copy of Website content solely to evaluate a potential business relationship. This permission does not transfer ownership or grant a license to manufacture, reproduce, distribute, sell, or create derivative commercial materials.

6. Information and files you provide

You retain any ownership rights you have in drawings, specifications, images, or other project materials you provide. You give us permission to review, reproduce internally, and use those materials only as reasonably necessary to respond to your enquiry or administer the requested project.

You represent that you have the right and authority to provide those materials and that our requested use of them will not violate another person’s intellectual-property, privacy, confidentiality, or contractual rights.

Sending information through ordinary email or other contact methods does not by itself create a nondisclosure or confidentiality agreement. If your project requires special confidentiality terms, arrange them with us in writing before sending highly confidential material.

7. Accuracy and availability

We aim to keep Website information useful and accurate, but general content may be incomplete, become outdated, or not apply to a particular project. Images, illustrations, descriptions, and examples are for general information and do not guarantee an exact production result.

We may correct, update, suspend, or remove Website content or functionality without notice. We do not guarantee that the Website will always be available, uninterrupted, secure, or free from errors.

8. Third-party websites

The Website may contain links to third-party websites or services for convenience. We do not control or endorse them and are not responsible for their content, availability, security, or practices. Your use of a third-party service is governed by its own terms and policies.

9. Disclaimers

To the maximum extent permitted by applicable law, the Website and its content are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement to the extent those warranties may lawfully be excluded.

Nothing on the Website is legal, regulatory, certification, testing, engineering, or other professional advice. Project-specific requirements must be independently reviewed and confirmed by the relevant parties and, where appropriate, qualified advisers or testing providers.

10. Limitation of liability

To the maximum extent permitted by applicable law, Titanium Frames will not be liable for indirect, incidental, special, consequential, or punitive loss arising from use of, inability to use, or reliance on the Website. Where liability cannot lawfully be excluded, it is limited to the minimum extent permitted by applicable law.

This section applies only to Website use. Liability relating to an accepted quotation, order, sample, or manufacturing project is governed by the separately agreed commercial documents for that transaction.

11. Applicable law and disputes

These Terms are governed by the laws that apply to the Website operator and the particular dispute, without giving effect to conflict-of-laws rules where they may lawfully be excluded. Before starting formal proceedings, the parties should make a reasonable effort to resolve a Website-related dispute through good-faith communication. Any unresolved dispute may be submitted to a court with jurisdiction under applicable law.

A separately accepted commercial agreement may specify different governing law or dispute-resolution terms, in which case that agreement controls for the relevant transaction.

12. Severability and waiver

If a provision of these Terms is found unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver of the right to enforce it later.

13. Changes to these Terms

We may update these Terms to reflect changes to the Website, our practices, or applicable requirements. The revised version will be posted on this page with a new “Last updated” date. Your continued use of the Website after an update means the revised Terms apply to later use.

14. Contact
